I applied to be regularised. Can I enrol in the City Council’s Registry?
Question: I’m a domestic worker who applied to be regularised last year. I’ve undersigned the Residency Contract (contratto di soggiorno) at the Immigrations Office at the Prefecture and applied for the Permit of Stay for work. Can I enrol in the City Council’s Registry (Anagrafe)?
Answer: Italian law obliges all be they Italians or foreigners, to enrol in the City Council’s Registry (Anagrafe). This is a register in which the personal data of the people who live in City Council are recorded.
In your case, for you to enrol, you must have undersigned the Residency contract and submitted the application for the Permit of Stay.
A Circular letter number 16 issued by the Ministry of Home Affairs in 2007 says that anyone who is waiting to be issued the Permit of Stay for subordinate work can proceed and enrol in the Registry of the City Council in his/her area of residence.
The Circular letter says that a foreign worker who has undersigned the Residency Contract at the Immigrations Office at the Prefecture and has applied for the Permit of Stay for work can legitimately exercise all the rights recognized to holders of Permits of Stay for work.
In order for you to register in the City Council’s Registry, you must show a copy of the Residency Contact, and the receipt you were issued at the post office when you submitted the application for the Permit of Stay.
You should go to the Registry Office of your City Council of residence with all the above documents and your ID documents such as passport and fiscal code.
It is important to keep in mind that if you are enrolled in the City Council’s Registry and your Permit of Stay expires, after renewing it, you must also renew the declaration of your residence in your City Council. You must do so within 60 days of renewing your Permit of Stay, or without it, you can submit a copy of the receipt you were issued at the post office when you applied for its renewal.
If you fail to do so you will be cancelled from the City Council’s Registry. Previously one could be cancelled from the City Council’s Registry a year after the expiry of the Permit of Stay.
That was changed by the Security Law which reduced it to six months. It is therefore important that you respect that deadline by either submitting a copy of the renewed Permit of Stay or the receipt showing you’ve applied for its renewal.
