Can I regularise my fiancée’s brother?

Question: Hi! My fiancée has a valid Permit of Stay for work and he would like to regularise his brother who came to Italy illegally. Since we have a baby with my fiancée, can I apply for family reunification with his brother, saying that he’s our babysitter? Thanks.

Answer: This can only done if you are an Italian citizen, meaning that your baby is also an Italian citizen. If this is the case, then you can apply to regularise the baby’s uncle. In order to do this, the baby’s uncle must be living in the same apartment with the baby. This gives him the right to apply for the Permit of Stay for family reasons. You can apply for this Permit of Stay directly at the local police station (Questura) by submitting the documents showing the family relationship and your living together. Thanks.
