Question: Hi! I’m an Ethiopian living in Italy legally. I’d like to marry my fiancée who is also from Ethiopia. Unfortunately she is in the country illegally. I heard that if she becomes pregnant she can be issued a special permit which can allow us to marry. Is this true? Thanks.
Answer: Should your fiancée become pregnant, according to Italian Law, she cannot be expelled until six months after the childbirth. During this period she has a right to be issued the Permit of Stay for medical treatment (permesso di soggiorno per cure mediche).
Once she obtains this permit, you can celebrate your marriage in Italy. With the marriage certificate together with all other required documents, you can apply to convert your wife’s permit from that of medical treatment to that of family reasons.
The Permit of Stay for medical treatment can only be renewed until six months after the childbirth. After this period, both the mother and the child will no longer be allowed to stay in Italy, so they’ll have return to Ethiopia.
It is therefore very important that you get married fast and apply for the conversion of this permit before it expires. Thanks.
